Terms of service

1. Acceptance of terms

By booking a scan, attending a BodyIntel scan event, or using this website, you agree to be bound by these terms of service. If you do not agree, do not use our service.

These terms apply to all users of the BodyIntel service, including individuals scanning at partner gym activations and gym operators entering into commercial arrangements.

2. Our service

BodyIntel provides mobile body composition scanning using InBody 970 body composition analysers. The service is delivered at partner gym locations across Newcastle and surrounding regions, New South Wales, Australia.

BodyIntel is an educational service. We provide body composition data and information to help individuals understand their body composition metrics. We are not a medical service.

3. Not a medical service

BodyIntel is an educational body composition scanning service, not a medical, clinical, diagnostic, or therapeutic service.

• Scan results do not constitute a medical assessment, clinical diagnosis, or medical advice
• Scan results do not diagnose, treat, prevent, or predict any health condition or disease
• BodyIntel operators are not acting as medical professionals, doctors, dietitians, or allied health practitioners in the context of this service
• You should not use scan results as a substitute for professional medical advice
• If you have health concerns, consult a qualified health or medical professional

Phase Angle and other scan metrics are body composition benchmarks only. They are not clinical indicators, disease predictors, or diagnostic tools.

4. Eligibility and contraindications

You must be 16 years of age or older to use the BodyIntel service without parental consent. Individuals under 16 require written parental or guardian consent.

You must not use the InBody 970 if you:

• Have an implanted electronic medical device, including pacemakers, implanted cardiac defibrillators, or neurostimulators
• Are pregnant
• Have been advised by a medical professional not to use BIA devices

By attending a scan, you confirm that you do not have any of the above contraindications, or that you have obtained clearance from a qualified medical professional.

5. Bookings and cancellations

Scan bookings are subject to availability at the relevant gym activation. BodyIntel reserves the right to reschedule or cancel a scan event due to circumstances including but not limited to equipment issues, venue cancellation, or force majeure events.

Where a scan event is cancelled by BodyIntel, affected participants will be notified and offered a refund or alternative booking. Cancellation terms for individual bookings will be specified at the time of booking.

6. Payment

Pricing for scans is as displayed at the time of booking. Prices are in Australian dollars and inclusive of GST where applicable.

Payment terms for gym partner arrangements are as specified in the relevant commercial terms agreed between BodyIntel and the partner gym.

7. Scan results

Scan results are provided for educational and informational purposes only. BodyIntel makes no warranty or representation regarding the accuracy of scan results in any particular circumstance, including where pre-scan guidelines were not followed.

Scan results are personal to the individual scanned. Individual scan results are not shared with third parties, including partner gyms, without the scanned individual's explicit authorisation. See our privacy policy for full details.

8. Limitation of liability

To the fullest extent permitted by law, BodyIntel's liability to you in connection with the service is limited to the amount paid by you for the relevant scan. BodyIntel is not liable for any indirect, consequential, or special loss or damage arising from use of the service or reliance on scan results.

Nothing in these terms excludes, restricts, or modifies any right, remedy, guarantee, warranty, or other term or condition implied or imposed by the Australian Consumer Law that cannot lawfully be excluded or limited.

9. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010). For major failures with the service, you are entitled to cancel your service contract and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage.

If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.

10. Intellectual property

All content on this website, including text, design, graphics, and the BodyIntel brand, is owned by or licensed to BodyIntel. You may not reproduce, copy, or distribute any content without prior written permission.

11. Changes to these terms

BodyIntel may update these terms from time to time. Updated terms will be published on this page with a revised date. Continued use of the service after updated terms are published constitutes acceptance of the updated terms.
